Terms of Service

Note: This is a translation provided for your convenience. In case of any discrepancy between this translation and the Portuguese version, the Portuguese version shall prevail.
Welcome to Monely! These Terms of Service ("Terms") establish the conditions for using our personal finance management app ("Service", "App" or "Monely"). By creating an account or using Monely, you agree to these Terms.
Monely is an app and service operated by CHARLES BERTI TECNOLOGIA DA INFORMAÇÃO LTDA, a limited liability company registered under CNPJ No. 66.037.451/0001-01, headquartered at Rua Pais Leme, 215, conjunto 1713, Pinheiros, São Paulo/SP, CEP 05424-150. In this document, references to "Monely", "we" or "Service" designate that company and the app it operates.
Please read these Terms carefully before using the Service. If you do not agree with any condition, do not use the App.
1. Acceptance of Terms
By accessing or using Monely, you confirm that:
- You have read, understood and agree to these Terms of Service;
- You have read and agree to our Privacy Policy;
- You have the legal capacity to enter into this agreement or, being a minor, you use the Service with the authorization and under the supervision of your legal guardian.
If you are using the Service on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms.
2. Description of the Service
Monely is a personal finance management app that allows you to:
- Record income and expenses manually (and by voice, through the Android widget);
- Record transactions via WhatsApp with an Artificial Intelligence assistant;
- Scan receipts and invoices for automatic recording (OCR);
- Import transactions from files (CSV, XLS, XLSX or OFX);
- Organize transactions by categories, labels and accounts;
- Set and track financial goals and investment objectives;
- Track loans and debts;
- Set up and track a credit limit;
- View reports and charts about your finances;
- Chat with an AI assistant to get personalized financial insights (subject to consent);
- Receive daily AI-generated insights about your financial habits (subject to consent);
- Share expenses in groups, including couples mode, with a split proportional to participants' income (optional);
- Take part in the referral program;
- Sync data across devices.
How your data enters Monely: financial data is entered by you, manually, by scanning a receipt (OCR), by importing a file or by message on WhatsApp. Monely does not connect to banks or to Open Finance or Open Banking systems and does not automatically import your account statements.
Expense splitting: in shared groups, the proportional split is calculated arithmetically, based on the income reported by each participant, without the use of artificial intelligence.
Important: Monely is a financial organization tool. We are not a financial institution, we do not offer credit, investments or banking services, and we do not automatically connect to your bank accounts.
3. Plans and Pricing
3.1 Available plans
Monely offers a free plan and paid subscription plans. The plans offered, their features, usage limits, prices and any promotional offers or discounts are presented within the app itself, in the official stores (Google Play and App Store) at the time of purchase, and on our website. These plans, features, limits, prices and offers may be changed at any time. The final price is always presented before the purchase is confirmed, and price changes do not affect the period already paid for a subscription in effect. Some paid plans may allow the subscription to be shared among members of the same family, according to the conditions shown at the time of purchase.
The free plan has usage limits, such as the number of records per period, presented within the app. When you reach a limit, you are notified and can subscribe to a paid plan or wait for the period to renew in order to continue using the free service.
3.2 Initial records bonus
New users may receive an initial bonus to try out paid features. The conditions and amount of the bonus are presented within the app itself and may be adjusted at any time.
3.3 No advertising
Monely does not display ads on any plan, free or paid.
4. Subscriptions and Payments
4.1 Payment Method
Subscription payments are processed exclusively through official stores:
- Google Play Store for Android devices;
- App Store for Apple devices (iPhone/iPad).
Available payment methods are those accepted by the respective stores, which may include credit card, debit card, bank slip, Pix or store credits.
4.2 Automatic Renewal
Subscriptions are automatically renewed at the end of each period (monthly or annual), unless you cancel before the end of the current cycle. Billing is done automatically by the corresponding store (Google Play or App Store).
4.3 Cancellation
There is no commitment. You can cancel your subscription at any time through the store settings (Google Play or App Store). Upon cancellation:
- You keep access to the paid plan until the end of the already paid period;
- After expiration, your account automatically reverts to the free plan;
- Your data is kept, but subject to the free plan limits;
- You can upgrade again at any time.
4.4 Refund
Refund policies are determined by the official stores (Google Play and App Store). Refund requests should be made directly through the store where the purchase was made. Monely does not process refunds directly.
4.5 Plan Change
When a paid subscription ends (by cancellation or non-renewal), if you have more resources than allowed in the free plan, your data will be kept, but you will not be able to create new records until you fit within the free plan limits.
5. Referral Program
5.1 Description
The Referral Program ("Refer and Earn") allows Monely users to invite friends and earn points for the ranking.
5.2 How it Works
When you refer friends with your unique referral code, you accumulate points for the ranking as they create an account and progress in their use of the app. The milestones that earn points, the values assigned and the accumulation rules are presented within the app itself and may be changed at any time.
5.3 Restrictions
We reserve the right to cancel points, including after they have been granted, if fraudulent behavior is identified, including points obtained through:
- Creating fake accounts;
- Self-referral (referring yourself);
- Any form of fraud or abuse of the program.
6. Registration and User Account
6.1 Account Creation
To use Monely, you must create an account providing true, complete and up-to-date information. You can sign up through:
- Email and password;
- Google account (Google Sign-In);
- Apple account (Sign in with Apple).
6.2 Account Responsibility
You are responsible for:
- Maintaining the confidentiality of your access credentials;
- All activities performed on your account;
- Notifying us immediately of any unauthorized use;
- Keeping your registration data up to date.
6.3 One Account per Person
Each person can have only one account on Monely. Duplicate accounts may be terminated without prior notice.
7. Acceptable Use
7.1 You Agree to:
- Use the Service only for personal and legal purposes;
- Provide true and accurate information;
- Respect intellectual property rights;
- Keep your access credentials secure;
- Comply with all applicable laws and regulations.
7.2 You Agree NOT to:
- Use the Service for any illegal or unauthorized purpose;
- Attempt to access other users' accounts;
- Interfere with or disrupt the operation of the Service;
- Use robots, scrapers or other automated tools;
- Transmit viruses, malware or malicious code;
- Collect information from other users without authorization;
- Resell, sublicense or commercially exploit the Service;
- Reverse engineer the application;
- Create fake or multiple accounts;
- Use the Service for money laundering or fraudulent activities.
8. Your Data and Content
8.1 Data Ownership
You retain all rights to the financial data you enter in Monely. We do not claim ownership of your personal or financial information.
8.2 License of Use
By entering data in Monely, you grant us a limited, non-exclusive and revocable license to process, store and display that data to provide the Service to you. This license includes the display of profile data (username and profile photo) to other users in the context of social features of the app, such as rankings.
8.3 Data Accuracy
You are responsible for the accuracy of the information you enter. Monely does not verify the accuracy of entered financial data and is not responsible for decisions made based on that information. When using automatic data extraction (for example, receipt scanning via OCR or AI processing), you are responsible for reviewing the extracted data before confirming the record.
8.4 Backup and Export
Monely adopts reasonable security measures and backup routines to ensure the continuity of the Service, but does not guarantee the full recovery of all data in every situation. We recommend that you keep copies of your important data. You can export your data at any time through the app settings.
8.5 Social Features and Rankings
Monely may offer social features, such as rankings and leaderboards, in which your profile information (username and profile photo) is displayed to other users of the app.
By using Monely and participating in these features, you:
- Authorize the display of your username and profile photo to other users in the context of rankings and community features;
- Grant image usage authorization for display purposes within the app, under the terms of Article 20 of the Brazilian Civil Code;
- Acknowledge that detailed financial data (amounts, transactions, categories) is not shared in rankings;
- May request the removal of your data from rankings at any time by contacting us or adjusting privacy settings in the app.
8.6 Artificial Intelligence Features
Monely offers optional features that use artificial intelligence (AI), including the WhatsApp assistant, the in-app AI chat assistant, receipt scanning (OCR), audio transcription, document import and personalized financial insights.
By using these features, you acknowledge and agree that:
- Prior consent: the use of AI features requires your explicit consent, requested within the app before first use. Without this consent, AI features will not be activated;
- Shared data: messages, images, audio, financial transaction data (amounts, categories, dates) and photos of receipts or documents may be sent for processing by third-party AI providers;
- AI providers: your data is processed by Google Cloud Vertex AI (us-central1 region, Iowa, United States) as the primary provider. OpenAI (United States) is used only as a fallback if the primary provider is unavailable. This constitutes an international data transfer, governed by the Data Processing Addenda of the respective providers. None of these providers use your data to train AI models. See the details of the international transfer in section 9 and of the AI processing in section 7.1 of the Privacy Policy;
- Nature of responses: AI-generated responses and insights are for informational purposes only and do not constitute financial, tax or investment advice. You are responsible for your own financial decisions;
- Accuracy: AI-generated responses may contain inaccuracies. Monely does not guarantee the accuracy, completeness or suitability of AI-generated content;
- Availability: the availability of AI features depends on the availability of the third-party providers used by Monely and may be interrupted if those providers become unavailable;
- Evolution: AI features may be subject to changes, limitations or discontinuation due to technological, regulatory or commercial changes;
- Revocation: you may revoke your consent at any time in the app settings, which will disable AI features without affecting other Monely features.

8.7 Analytics and Measurement
To improve the app and measure the effectiveness of Monely's own outreach campaigns, we collect usage data after your account is created, as described in section 1.4 of the Privacy Policy. Monely does not display ads within the app and does not use the advertising identifier for personalization or remarketing. You may object to this collection at any time through the contact channel or by deleting your account, and you can enable or disable the artificial intelligence features in the app settings.
9. Intellectual Property
9.1 Monely Rights
Monely, including its design, source code, logos, trademarks, texts, graphics and other elements, are the exclusive property of Monely or its licensors and are protected by intellectual property laws.
9.2 Limited License
We grant you a personal, limited, non-exclusive, non-transferable and revocable license to use the Monely app, exclusively for personal purposes and in accordance with these Terms.
9.3 Restrictions
You may not copy, modify, distribute, sell, rent, sublicense, decompile, reverse engineer or create derivative works of Monely without our express written authorization.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
We do not guarantee that:
- The Service will function uninterrupted or error-free;
- The results obtained will be accurate or reliable;
- Defects will be corrected;
- The Service will meet your specific expectations;
- The Service will be available at all times or locations.
Availability and maintenance: Monely may perform scheduled or emergency maintenance, as well as updates, which may result in temporary unavailability of the Service. Whenever possible, we will announce scheduled maintenance with reasonable advance notice.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- Monely will not be liable for any indirect, incidental, special, consequential or punitive damages, including loss of profits, data, use or other intangible losses;
- Except in cases of willful misconduct or gross negligence and the rights guaranteed to consumers by applicable law, Monely's liability is limited, to the maximum extent permitted by law, to direct and duly proven damages;
- We are not responsible for financial decisions you make based on information displayed in the app;
- We are not responsible for failures resulting from third-party services.
Force majeure: Monely will not be liable for delays or failures arising from events beyond its reasonable control, including natural disasters, power outages, unavailability of third-party providers, internet infrastructure failures or governmental orders.
12. Indemnification
You agree to defend, indemnify and hold harmless Monely, its directors, employees, partners and service providers from any claims, damages, obligations, losses, costs or expenses (including attorney fees) arising from:
- Your use of the Service;
- Violation of these Terms;
- Violation of third-party rights;
- Content you enter into the Service.
13. Suspension and Termination
13.1 By You
You can terminate your account at any time through the app settings or by contacting us. After termination, your data will be treated according to our Privacy Policy.
13.2 By Us
We may suspend or terminate your account, at our discretion, if:
- You violate these Terms;
- You provide false information;
- Your use poses a security risk to the Service or other users;
- We are required by law;
- We decide to discontinue the Service.
13.3 Inactive Accounts
Free accounts inactive for a prolonged period may be removed upon prior notice, by email or in the app, when reasonably possible.
13.4 Effects of Termination
After account termination, you will lose access to the Service and stored data, which will be deleted in accordance with our Privacy Policy, except where legislation requires its retention (for example, legal, tax or regulatory obligations). We recommend exporting your data before requesting termination.
14. Modifications to the Terms
We may modify these Terms at any time. When we make significant changes:
- We will post the new Terms in the app and on the website;
- We will notify you through the app and/or email;
- We will indicate the date of the last update.
Continued use of the Service after changes constitutes your acceptance of the new Terms. If you do not agree with the changes, you should stop using the Service and terminate your account.
15. Modifications to the Service
We reserve the right to modify, update, add or discontinue features and functionality (free or paid) and to change technical requirements at any time. When a change significantly affects the use of the Service or entails its discontinuation, we will provide prior notice when reasonably possible.
Integrated features: some features depend on the availability of third-party platforms and services, including messaging providers (such as WhatsApp), Google, Apple and artificial intelligence providers. Any limitations, changes or interruptions of these services, including due to API modifications or new restrictions imposed by the providers, may temporarily affect certain features of Monely, without prejudice to the app's other features and without this entailing any liability on the part of Monely.
16. Communications
By creating an account, you agree to receive electronic communications from Monely, including:
- Verification and security codes;
- Notifications about scheduled payments;
- Notices about changes to the Terms or Service;
- Promotional and marketing communications (optional), subject to consent when required by applicable law.
You can manage your communication preferences in the app settings.
17. General Provisions
17.1 Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Monely regarding the use of the Service.
17.2 Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
17.3 Waiver
Monely's failure to exercise or enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
17.4 Assignment
You may not assign or transfer your rights under these Terms without our authorization. We may assign our rights at any time without notice.
18. Governing Law and Jurisdiction
These Terms are governed by the laws of the Federative Republic of Brazil.
To resolve any controversy arising from these Terms, the jurisdiction of the user's domicile is elected, as established by the Consumer Defense Code (Law No. 8.078/1990).
